Camille2: Dear Visa Officer, I am a graduate student in a U.S. university. My family was refused once for B2 visa application in Beijing this year. We would like to apply for B2 visa again, and I read from the embassy website that visa application are not restrained even if the person has been refused once. However, I found there is no openning slot in Beijing for second time applications such as this, not even for people who were refused once in February or March 2008. Could you please help us with this? We are just hoping for a chance of family reunion during summer holidays, after August my family would have to go back to work and wouldn’t be able to come here… Could you please help with this? 美国签证官: Summer is our busiest season and the demand for visas to the U.S. is especially great this summer. We can only provide appointments for a certain number of people, based on the size of our waiting rooms and the number of visa officers we have. First priority for appointments is for students and business travelers. People who have
already been refused a visa do have to wait longer, in order to give other people a chance to apply. Visas are usually valid for one year, so we always encourage people to apply as early as possible. You could check again with the visa call center to see if your family can get an appointment, as we will be able to open a limited number of new appointments in July and August.

The problem is that we see many applicants who are not legitimate travelers going to the U.S. for “business investigations.” Sometimes, these applicants are not employed where they say they are, or their invitation letters are fraudulent. If you feel that you are qualified for a visa under U.S. immigration law, you are welcome to reapply for a visa.

美国签证官: Answer: I am not sure I completely understand your situation. In order to do an “internship” in a U.S. hospital, you would have to go through a specific program that was authorized to run such a program and apply for the correct type of visa. Rules on non-U.S. citizens and students who want to learn more about hospitals are very strict. You can find the relevant section of U.S. immigration law that relates to medical students coming to the U.S. on the internet. I suggest you fully investigate the law before you apply. The hospital should be able to help you with that if they are running a legitimate program.

美国签证官: It sounds like your passport has already expired. Your passport must be valid for at least six months from the time that you plan to enter the U.S or you will not be allowed to enter the country and will turned around at the airport. If your passport expired while you were in the U.S, you could apply for another one at the Chinese Consulate in the U.S. It would not matter that your visa was in your old passport, or that your visa expired, as long you keep the passport with the visa in it and of course, as long as you are still in your J1 program and your DS2024 is still valid.

Now i have already been refused to get the F-1 visa and the visa officer didn’t give me any chance to explain it.Actually i just want to study in the United States, not immigration. I have withdraw my immigrant visa and someone in the United States want to garentee that I will come my China after my graduation. Is that enough? What shall he do? 美国签证官: Someone else cannot guarantee that you will return to China; however, if someone wants to write a letter to support you that is fine (it should be in English). You need to explain to the visa officer why your parents applied for the immigrant visa, and when and why you withdrew your immigrant visa application. Also, you should explain where your parents are now, and what they are doing. You need to convince the visa officer that you do not plan to immigrate to the U.S. This will be harder for you than for other people, since your parents clearly wanted you to immigrate at some point. However, we understand that circumstances can change. You should be ready to explain this clearly and quickly at your next interview.

美国签证官: Yes, when you renew your visa, you must also submit your transcripts for all the time that you were in the U.S. studying. The visa officer needs to verify that you are still a full-time student.

美国签证官: ANSWER: According to U.S. immigration law, the visa officer cannot issue a visa to someone who is an intending immigrant. Since your sister has already filed an immigrant petition for you, it is very difficult to prove that you are not an intending immigrant. Legally, the visa officer can issue you a B2 (nonimmigrant visa) only if he or she is satisfied that you do not intend to immigrate to the U.S. and abandon your residence abroad. If you feel you can satisfy this requirement, you are welcome to reapply. Based on the situation you describe above, it sounds like you could meet the requirements, but only the visa officer who interviews you can determine whether or not you are qualified for a visa.
根据美国移民法,签证官不能够为有移民倾向的人签发签证。既然您的姐姐已经为您申请了移民签证,那您就很难证明您不是有移民倾向的人。就法律上来说,签证官只有在他/她完全相信您不打算移民美国也不打算放弃自己在美国以外居住的时候才能给您签发B2签证(非移民签证)。如果您觉得您能满足这个条件,我们欢迎您重新申请。根据您上面的描述,听起来您可以达到这些要求,但必须是给您做面谈的官员才能决定您是否符有资格得到签证。

Bruce2: Hi, I have an actual question about my visas. I plan to US as a visiting scholar in a university in Nov. 1, 2008 (I think it needs a J-1 visa). But before my visiting, I have to attend a conference held in Honolulu, Oct. 12~18 (I think it needs a B-1 visa) and will to return to China right after the conference. So, since my two entrances to US are quite close, how could I apply for my visas? May I apply for two visas in a single interview? What can I do then? 美国签证官: This is a very good question. You could apply for the two visas at the same time, but, you can only apply for the J1 visa 120 days before your program starts. Also, you need to have your DS2024 before you can apply for the J visa. We always recommend that people apply for the visa as early as possible. It might be safer to apply for the B visa as soon as possible. You could always make another appointment to get the J1 visa after you get the B visa, even if you have not yet traveled on the B visa. People 7 going to the U.S. on J and F visa have priority for visa appointments. Keep in mind that it could take a month or more to process your visas.

Answer: This is correct, visas for residents of the PRC are limited to 12 months. This is based on agreements between governments and cannot be changed by the visa officer. We suggest you apply a few months before you plan to travel. 您说的情况是正确的。中华人民共和国居民的签证有效期是 12个月。这是基于两国政府之间的协议制定的,签证官员无法改变。我建议您在计划旅行之前头几个月申请。

I just finished the ESLI(English as Second Language International) program in my university, and I will be a freshman when I back from China in September. The case is I need to renew my Visa. The first thing I want to ask is I changed my major before I go to University, so my major is different from the major that appeared on the I-20 now, is that Ok? The second is I plan to use the drop-off service to renew my Visa, the grade I have is the ESLI’s grade but not Univertsity’s grade, and the grade is not the kind of official transcript, I want to know if it is acceptable. The third is if I will not use the drop-off service, I want to do the interview, need I prepare the Proof of Finances as before? Thank you very much.
美国签证官: Whether or not you use the drop-off service or come for the interview is up to you, but from what you describe, it sounds like it might be hard for the visa officer to understand your situation without talking directly to you. It would be better if you could show an official transcript, but if you cannot, perhaps you could ask your ESL program for a letter explaining 8 why you do not have an official transcript. If you changed your major, you should get a new I20, please ask your school for advice. You can bring both the old and new I20s to the interview. The officer will probably not ask for your proof of finances, but it cannot hurt to bring them.

Special processing could be taking longer because there are many, many students from all over the world applying for visas that need special processing and this can slow down the process. If your wife has been waiting for more than two months, I suggest she send a fax with her information to the embassy or consulate where she applied. There could be a problem with her application, for example a missing document.

However, summer is a very busy time and students who have already been refused may have to wait a bit longer for an appointment. Royal Caribbean should advise your wife what kind of visa she 10 needs, it depends on where she boards the ship and whether or not she will get off the ship in the U.S., etc.

Make sure to include a copy of your visa, his birth certificate, his endorsed I-20, and copies of your transcripts so that the visa officer knows you are still in student status.

This just means that according to U.S. visa law, an applicant has to prove that they have social and economic “ties” to a home outside the U.S. that they do not intend to abandon. In other words, you have to show the visa officer that your life outside of the U.S. is such that you would not have any intention of staying illegally in the U.S. “Ties” can refer to family, friends, a career, property, etc. Sometimes it is harder for applicants to qualify for a visa when they are in a third country. Just because you were refused a visa in Seoul does not mean you are not qualified for a visa. Usually, in Beijing, people going to schools like Yale do not have any problems qualifying for a visa.

美国签证官: In general, applicants should always bring copies of their old passports and visa extensions to the interview. You should try contacting the Department of Homeland Security to see if they can provide copies of your parents visa extensions. If not, you should write a letter, in English, explaining when your parents were in the U.S., when they got their extension, etc. And, your parents should be ready to explain this. What is important is to demonstrate that your parents were not in the U.S. illegally. The visa officer will need to know when your parents left the U.S. and returned to China.
